Oasisfactor Lda (“Oasisfactor” or “We”) operates under the brand name Tagpeak (“Tagpeak”). Oasisfactor offers its customers (“Customer” or “You”) the opportunity to earn rewards (“Reward” or “Rewards”) on purchases made through Tagpeak’s platform with our partner brands (“Partners”).

By using the Tagpeak platform, you acknowledge that you have understood and agree to these Terms and Conditions.

These terms, their subject matter, and their formation are governed by the laws of Portugal. Any disputes arising will be subject to the exclusive jurisdiction of Portuguese courts.

Operating Brand

Oasisfactor Lda operates its services and platform under the brand name Tagpeak. References to “Tagpeak” in this document represent the trading name used by Oasisfactor for its activities. The company retains full responsibility for all obligations, services, and communications provided under the Tagpeak brand.

Earning Rewards

1. Eligibility Requirements:
   • To earn Rewards, you must:
     • Be registered on the Tagpeak platform.
     • Use the shopping links provided on the platform to make purchases with our Partners or any other form made available by our Partners, e.g. a discount code to identify the transaction.
     • Enable cookies to allow accurate tracking of transactions. Using adblockers and certain anti-virus software may interfere with the tracking. We reject any liability for any missed transactions, although we make efforts to recover any missed data.
     • Complete your purchase transaction during the same shopping session you started after clicking on the shopping link.
     • If you visit other sites or tools such as coupon injectors, cashback extensions, points extensions, etc. before completing your purchase, your purchase might be associated with a service other than Tagpeak and you might not earn Rewards on your purchase
2. Tracking and Validation:
   • Your transaction will appear in your account dashboard (“Tagpeak Monitor”) shortly after completion. However, Rewards will only be confirmed after validation by the Partner, which may take several weeks to account for return periods or service fulfilment.
3. Reward Investment:
   • After validation, Tagpeak will invest an amount equivalent to a percentage of your purchase (excluding VAT) in financial assets of our choosing. These investments are designed to enhance your Reward but may result in variable outcomes.
   • The Reward may increase, remain constant, or decrease, including reaching 0% of your purchase amount.
4. Reward Availability:
   • The Reward typically matures over a period of 4-6 months. After the investment period, the final Reward amount will be made available for withdrawal.
   • Users may choose to stop the Reward at any time, locking in the value displayed in their Monitor at the time of their request. We aim to take action as soon as possible, subject to exchange trading hours. Final amounts may vary slightly due to market conditions and settlement timing.
5. No User Risk or Investment:
   • The funds invested belong to Oasisfactor until the Reward is disbursed. Users bear no financial risk, and no contributions or investments are required from them.

Receiving Payments

1. Withdrawal Process:
   • Users may withdraw the Rewards after the investment period ends or earlier if they stop the Reward.
   • Withdrawals will be processed to the user’s verified bank account in Euros.
2. User Responsibility:
   • Users are responsible for ensuring accurate bank account details and providing proof of ownership as required (IBAN confirmation or equivalent).
3. Tax Obligations:
   • Tagpeak does not withhold taxes on Rewards. Users are solely responsible for any tax liabilities in their jurisdiction. Rewards are considered rebates tied to purchases and not income.

Referral and Loyalty Programs

1. Loyalty Tiers:
   • Users start as Member but can progress through loyalty tiers to boost the Rewards:
     • Silver Tier: Earned after 1 successful referral or €500 spent. Baseline rewards are boosted by 10%.
     • Gold Tier: Earned after 5 successful referrals or €5,000 spent. Baseline rewards are boosted by 20%.
2. Referral Program:
   • Users may refer others to Tagpeak using their unique referral code.
   • Rewards for referrals:
     • Silver Tier: 5% of the referred user’s all-time total Rewards.
     • Gold Tier: 10% of the referred user’s all-time total Rewards.
   • A successful referral is defined as a referred user completing their first transaction.

1. Variable Rewards:
   • Rewards are subject to fluctuations based on the performance of Tagpeak’s investments. There is no guarantee of a specific outcome.
2. No Financial Services:
   • Tagpeak is not an investment service. Rewards are funded by commissions from Partners and are provided as rebates linked to purchases.
3. User Risk-Free:
   • Users do not bear any risk, as the funds invested belong entirely to Oasisfactor until disbursed.
4. Cross-Border Applicability:
   • Rewards and terms apply to users globally, subject to compliance with local laws.
